These Terms of Service ("Terms") govern your use of the Benemio website at benemio.com and your purchase of products from Benemio, a consumer brand owned and operated by Vitalyn Labs Inc., incorporated in Ontario, Canada. Benemio is powered by Shopify, which enables us to provide our services to you.

By accessing this website or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use or access our services.

SECTION 1 - ACCESS AND ELIGIBILITY

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You have given us consent to allow minor dependents to use the services on devices you own or manage.

Placing an order constitutes an offer to purchase. Benemio reserves the right to accept or decline any order at its discretion. Your order is not accepted until Benemio confirms acceptance and processes your payment. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted. If we do not accept or cancel an order, we will attempt to notify you using the contact information provided at checkout. If an order is cancelled after payment is collected, a full refund will be issued to the original payment method.

All purchases are for personal or household use only and not for commercial resale or export.

Prices are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be confirmed in your order confirmation email. Unless otherwise stated, prices do not include taxes, shipping, or handling charges.

Benemio is powered by Shopify, which enables us to provide our services to you. However, all sales and purchases are made directly with Benemio. By using our services, you acknowledge that Shopify is not responsible for any aspect of transactions between you and Benemio, including any injury, damage, or loss resulting from purchased products. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from your transactions with Benemio.

Benemio products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. We may terminate your access to our services at any time without notice if we determine you have violated these Terms. You remain liable for all amounts due through the date of termination. Provisions that by their nature should survive termination, including intellectual property, limitations of liability, and indemnification, will continue to apply.

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law and severed from the remaining Terms, which will continue in full force and effect.
